This article analyzes the legal relationships among the rewarder, the rewarded, and the platform company, pointing out that the “gift contract theory” overlooks the consideration attribute, the “service contract theory” is difficult to apply, and the “no contract relationship theory” fails to explain the logic of property transfer. High-value rewards without consent are usually deemed invalid as significant property expenditures. As an intermediary, the platform bears regulatory obligations, and if it fails to fulfill its responsibilities, it may bear joint and several liability. This article suggests establishing a cooling-off period and a ratification mechanism, clarifying rules for property restitution and debt apportionment, improving laws and regulations, and strengthening industry supervision to regulate the live streaming economy and balance the needs of family property rights and the development of the online economy.
随着数字化技术的高速发展,电子商务在全球范围内迅速崛起,成为经济活动的重要组成部分。电子合同作为电子商务交易的核心内容,对电子合同法律效力与证据认定问题的研究具有重大的法律意义。本文旨在探讨电子商务法中电子合同的法律效力中所涉及的电子证据认定问题,目前我国司法实践中对于电子证据的适用仍存在很多争议,由于电子证据本身所存在的无形性、易于篡改等特点,实践中存在着电子证据不充分,采信度不高,证据认定困难等困境。本文从证据的理论及特征出发,找寻电子证据的核心概念,提出应该规范电子数据原件认定、扩大证据主体的范围、优化公证流程等有效措施,以期为电子商务的健康发展提供法律保障,推动司法实践工作的顺利进行,提高当事人对于电子证据效用的信任度。With the rapid development of digital technology, electronic commerce has surged globally and become an essential component of economic activities. This paper aims to explore the issues related to the identification of electronic evidence in the legal effectiveness of electronic contracts within the framework of electronic commerce law.
